Estate & Probate

Initial Consultation and Case Assessment

  • Evaluate the estate to determine whether probate is necessary

  • Advise on the probate process, timeframes, and costs

  • Discuss the roles and responsibilities of the executor or personal representative

Estate Planning

  • Review existing wills, trusts, and other estate planning documents

  • Advise on tax implications and potential estate liabilities

Initiation of Probate Process

  • File initial documents with the court to open the probate case

  • Notify creditors, beneficiaries, and other interested parties

  • Obtain letters testamentary or letters of administration, authorizing the executor or administrator to act

Asset Management and Protection

  • Identify, locate, and inventory all estate assets

  • Appraise the value of estate assets

  • Manage and protect estate assets during probate, including the sale of property if necessary

Debts and Claims

  • Notify creditors and evaluate claims against the estate

  • Pay valid debts and dispute invalid claims, if necessary

  • Handle tax filings for the estate, including income, estate, and inheritance taxes

Legal Documentation and Filings

  • Prepare and file all required court documents, including inventory lists, accounting statements, and petitions

  • Comply with all legal notifications and publication requirements

Distribution of Assets

  • Execute the distribution of assets to beneficiaries as per the will or state law in the absence of a will

  • Transfer titles and deeds to the appropriate parties

  • Distribute any remaining funds

Conflict Resolution

  • Mediate disputes among beneficiaries, creditors, or other interested parties

  • Represent the estate in court if there are challenges to the will or other conflicts that require judicial intervention

Closure of Estate

  • File final accounting statements with the court

  • Obtain court approval for the distribution and closing of the estate

  • Distribute any final assets and close out estate bank accounts

Post-Probate Matters

  • Assist with trust administration if any assets are held in a trust

  • Provide ongoing legal advice to beneficiaries or trustees
